Why we collect information about you?

  1. The Town and Country Planning (Local Planning) (England) Regulations 2012 requires councils to consult the public on local plans, which includes the Joint Core Strategy (JCS) Review.

  2. The JCS Review is a strategic level development plan document that is being prepared jointly by Gloucester City Council, Cheltenham Borough Council and Tewkesbury Borough Council. The review includes retail and city / town centres.

  3. The councils have agreed that Tewkesbury Borough Council will act as the lead authority for the JCS Review and collects personal data on behalf of the three councils to enable them to consult on the plan review.

  4. We collect information from you when you respond to a consultation. This information is kept on a JCS consultation database, so we can contact you when we consult on future versions of the plan, if you have asked us to do so.

  5. If you respond to a consultation we will ask you if you want your details retained, so we can notify you of other key stages of the plans progression. You can also ask to be notified without submitting a consultation response at any time.

  6. As the JCS Review progresses, we may ask you if you want to be notified when the plan is submitted to the Secretary of State for public examination.

  7. You have the right to withdraw your consent for the council to hold your data for consultation purposes at any time. You can change your preferences and stop receiving updates by accessing the consultation database yourself. To do this: go to the online portal. Alternatively, contact us and we will alter them for you or stop contacting you, if you wish. Any comments you have made previously will be kept, but personal data will be removed, making them anonymous.


What information do we collect about you?

  1. Personal data: name, postal address, organisation, email address, telephone number(s), planning agent (if applicable).

  2. Your response/comments you make in connection with the local plan publications, such as to the Joint Core Strategy Review.


Who do we share the information with?

  1. The information you provide is separated into two types of data a) personal data and b) your response or comment to a consultation.

  2. Responses to consultations are used to inform future stages of plan making and ultimately become evidence for public examination of plans. These will be shared with the three JCS authorities (Gloucester City Council, Cheltenham Borough Council and Tewkesbury Borough Council) and published on this JCS website and the three JCS authorities website’s, as necessary. If we publish any of your responses or comments, we will edit them to exclude your personal information.

  3. Your personal information will not be made available to the public, but is shared between the councils and with the Inspector of the JCS Review and their programme officer. They will use this information to contact you regarding your response(s) to the JCS Review consultation(s), both generally, unless you have not asked to be so notified, and where legally required to under the Town and Country Planning (Local Planning) (England) Regulations 2012.


Is any information transferred to or stored on servers based outside the European Economic Area?

No. The information is stored on servers based in the UK.


How long do we keep your information?

  1. Consultation responses remain available to the public for the length of the JCS Review plan-making and any appeal process.

  2. Responses will be removed from public view once the plan has been adopted and after the time-limit on any legal challenge has expired.

  3. Responses and contact details of people who submit a response to the JCS Review consultations will be retained for 6 years, unless we are requested to remove them by the people concerned. If responses are kept, they will be edited to exclude people’s personal data.

  4. After 6 years, personal data will be removed. Consultation responses will be retained for the purpose of historical research and sent to the public archive.


Who do we collect information from?

We collect the information from members of the public, statutory bodies and those in the development industry who wish to respond to the JCS Review consultation(s).


What are the consequences if we do not collect the data?

The councils’ are legally required to consult on local plans as set out in The Town and Country Planning (Local Planning) (England) Regulations 2012. If you withdraw your consent to the councils holding your personal data before the plan is submitted to the Secretary of State, your comments will not be taken into account and we will not be able to advise you of any future consultations. If you withdraw your consent after the plan has been adopted, your comments will be retained as evidence and for historical research, but your personal data will be removed, making them anonymous.


Are any decision about you made by automatic means?

No automated decisions are made about you.
